Additional Information:      The Office of Attorney General dates from 1807, when the territorial legislature provided for the appointment of an Attorney General for certain specified portions of the Mississippi Territory, one of which included the territory now embraced within the State of Alabama. In 1818 an act was passed laying off the Alabama Territory in three districts, and providing an Attorney General in each. The Office was carried into the Constitution of the State in 1819, the Attorney General to be elected by joint vote of the legislature, and to hold office four years. Since 1876 he has been elected by the people. The Constitution of 1868 made the Attorney General one of the executive officers of the State, the Office prior to that date being classed with the judiciary. Soon after the formation of the State, the Attorney General, in addition to other duties, was required to perform the duties of solicitor in the judicial circuit which embraced the seat of the State Government. In 1868 the Office was reorganized, and the powers and duties enlarged.

     Prior to the Code of 1867, section 108, subdivision 5, there was no requirement that the Attorney General make reports. That law provided for an annual report to the Governor in which, among other things, he should make such suggestions, tending to the suppression of crime, as he may deem proper. This subdivision further prescribed that the Attorney General must also include a consolidated statistical report from the reports made to him by the solicitors of the different judicial circuits. In 1884 the first printed report was issued, covering the years 1882/84. An act of February 21, 1893 enlarged the scope of the report, adding “such Opinions of the Attorney General as may be deemed of public interest.” The biennial report for 1894/96 was the first to contain Opinions, which continued to appear regularly, with one or two exceptions, until the last report of 1936/38. In 1935 a legislative act changed the requirement for the publication of the Opinions of the Attorney General. This act provided: “That in addition to the other duties of the Attorney General, and other reports now required of him by law, it shall be the duty of the Attorney General each three months, to publish in pamphlet form copies of such written official opinions as shall have been rendered by him... .” (Alabama General Acts, 1935, p. 1114, Sec. 1). The first Quarterly Report of the Attorney General of Alabama covers the period from October 1 through December 31, 1935. These quarterly reports have been published regularly until the present time. The checklist below indicates that for the period of October 1, 1935, through September 30, 1938, the Biennial Report and the Quarterly Report were duplicating the reporting of Opinions. The legislative requirement which provided that the solicitors submit statistics to the Attorney General for incorporation Into his report was repealed by an act of July 12, 1943. Since this repealer was passed, the statistical material based on the reports of the solicitor is no longer published in the Quarterly Report. The last such statistics presented were those for the period from October 1, 1938. to October 1, 1942, published in volume XXVIII, Quarterly Report of the Attorney General of Alabama, July 1-September 30, 1942. The present statutory requirements as to the reports of the Attorney General are based upon an act of February 21, 1939, which is incorporated into the Code of Alabama (1940) (Recomp. 1958) as Title 55, Section 228. This section restates the requirement as to the quarterly reporting of Opinions. Further, it stipulates that the Attorney General “must in the month of October of the last year of his term of office compile a report, which said report shall comprise and include such suggestions tending to the suppression of crime and the improvement of the criminal administration as he may deem proper.” It further prescribes that certain statistical information must be included in this four-year report. A letter of April 17, 1964, from the Office of the Attorney General of Alabama, states that the four-year report is usually informal, submitted in letter form, and that no copies are available.

     In April 1953 the Alabama Department of Examiners of Public Accounts published a two-volume, loose-leaf Index, Attorney General Opinions. This two-volume work initially covered all the Opinions of the Alabama Attorneys General which had appeared In the Biennial Reports and Quarterly Reports as of the time of publication of the index, and supplements from time to time have kept this work current.
