Edited by his son, the first volume being a memoir by hisbrother, George Ticknor Curtis, the second containingselections from his writings. Benjamin Robbins Curtis wasappointed to the U.S. Supreme Court where he achieved hisgreatest fame in 1857 by his dissenting opinion in the DredScott case. Curtis argued that residence of a slave with hisowner in free territory conferred freedom that the slavecould vindicate on his return to slave territory. Heclaimed also that the Court could not try the case because aslave was not considered a citizen. The impeachment trialof Andrew Johnson, in which he served as the president'sleading counsel, was perhaps his finest hour.
