Enacted in an unusual display of bipartisan unity, the Defend Trade Secrets Act of 2016 allows owners of stolen trade secrets, who formerly had to bring action under state laws, to sue in federal court. The new law is closely aligned to the Uniform Trade Secrets Act, which in some form has been adopted by most of the states. The new law does not preempt the state laws, but instead supplements them and offers victims of trade secret thefts the option of bringing action in federal court.
