It provides that ownership or control vests with the lineal descendants or with the organization on whose land they were located or which has the closest cultural affiliation. The Act has been critized for its unclear definitions of "cultural affiliation", "sacred objects", and "Native American" and for the failure to provide for DNA testing to determine the group with the closest affiliation. The most controversial aspect has been the creation of a conflict between museums and scientists who wish to retain their items and Native Americans and Hawaiians who are anxious to reclaim them.
